In accordance with the provisions of articles R6352-1 and following of the Labor Code, failure to comply with the provisions of the internal regulations or any behavior considered to be misconduct will result in the application of sanctions according to the following regime:

When the director of the training organization or their representative intends to impose a sanction, the director or their representative summons the trainee, specifying the purpose of this summons. This notice specifies the date, time, and place of the interview. It is written and sent by registered letter or handed over to the person concerned against a receipt.

During the interview, the trainee may be assisted by a person of their choice, in particular the intern representative. The summons indicates this possibility. The director or their representative indicates the reason for the proposed sanction and gathers explanations from the trainee.

The sanctions implemented in the school are of three types, in increasing order:

  • the issuance of a warning, serving as a formal notice to comply with the provisions of the internal regulations;

  • Temporary exclusion in the event of a first recurrence;

  • Permanent exclusion in the event of a new recurrence.

However, any act of physical violence affecting the physical integrity of other individuals or materials will result in an immediate suspension of 3 working days and then a sanction that may lead to permanent exclusion.

Likewise, any verbal violence affecting respect for individuals will result in an immediate suspension of 3 working days and then a sanction that may lead to temporary exclusion of 7 days and permanent exclusion in the event of a recurrence.

The sanction may not be imposed less than one full day or more than fifteen days after the interview. It is the subject of a written and reasoned decision, notified to the trainee by registered letter or handed over against receipt. The director of the training organization informs the employer and the funding organization of the sanction imposed, if necessary.

ARTICLE 14: TRAINEE REPRESENTATION

In application of article L6352-3, in each training course lasting more than 500 hours, a titular delegate and a deputy delegate are elected simultaneously in a two-round uninominal ballot. All trainees are eligible to vote.

Voting takes place during training hours, no earlier than 20 hours and no later than 40 hours after the start of the course. The training organization's director or his representatives are responsible for the organization and smooth running of the ballot.

Delegates are elected for the duration of the course. Their functions come to an end when they cease, for whatever reason, to take part in training courses.

If the titular delegate or alternate delegate ceases to hold office before the end of the course, a new election is held.

Delegates make all suggestions for improving the running of courses and trainees' living conditions in the training organization. They present all individual or collective complaints relating to these matters, to health and safety conditions, and to the application of internal regulations. They are empowered to inform the training team of trainees' observations on issues relating to problems encountered during training, and take part in the mid-term pedagogical meeting.
